Welcome to ShortMind. ShortMind is operated by Guangzhou Jitan Technology Co., Ltd. (广州极探科技有限公司) and provides websites, web applications, account services, AI clipping, caption generation, content reformatting, export, publishing, and related products, services, and features (collectively, the "Services").
These Terms of Service are a legally binding agreement between you and us regarding your access to, registration for, purchase of, and use of the ShortMind Services. Please read these Terms carefully, especially the sections relating to fees, prohibited conduct, limitations of liability, and dispute resolution.
By registering an account, clicking to agree, purchasing plans or credits, or otherwise continuing to access or use ShortMind, you acknowledge that you have read, understood, and agreed to be bound by these Terms, the applicable product descriptions, and the relevant rules posted on our pages. Privacy-related matters are governed by the ShortMind Privacy Policy.
If you are located outside mainland China and the laws applicable in your jurisdiction impose higher mandatory standards for consumer protection, auto-renewal, privacy, digital content use, or dispute resolution, those mandatory standards will prevail to the extent applicable.
1. Scope and Updates
These Terms apply to your access to and use of the ShortMind website, account system, AI clipping functions, caption generation, content reformatting, export, publishing, subscriptions, credits, and related add-on services.
We may revise these Terms in response to changes in law, product features, operations, or risk control requirements. Updated Terms will be posted on the relevant page and will apply from the effective date. If an update may materially affect your important rights or obligations, we will provide reasonable notice.
If you do not agree to the updated Terms, you should stop using the relevant Services. Your continued use of ShortMind after an update takes effect constitutes acceptance of the updated Terms.
2. Who May Use the Services
- You must have the legal capacity required for your use of the Services. If you are under 18, you should use the Services only with the consent and guidance of your parent or guardian. If you are under 14, you must not register, make purchases, or upload content containing personal information without explicit guardian consent.
- If you use the Services on behalf of a company, institution, team, or other organization, you must have authority to bind that entity to these Terms and to use the Services on its behalf.
- You are responsible for ensuring that your registration, payment, uploads, publishing activities, and commercial use of the Services comply with the laws and regulations applicable to you and to the regions where your content will be made available.
3. Account Registration and Security
If you become aware of account misuse, abnormal login activity, permission anomalies, or other security risks, please notify us immediately through our in-product channels or at support@shortmind.ai. We may take reasonable protective measures such as identity verification, temporary restrictions, freezing, device logout, or other safeguards based on the level of risk.
- You must provide true, accurate, complete, and up-to-date information during registration, purchase, and use of the Services, and promptly update it when necessary.
- Without our written permission, you may not transfer, lease, lend, sell, or share your account, access credentials, API keys, or other authentication tools.
- You are responsible for safeguarding your password, verification codes, access tokens, and device credentials, and for all activities that occur under your account.
4. Service Features and License
ShortMind is designed to help users turn long-form videos, live stream recordings, or other source materials into short-form content assets, including clip identification, title suggestions, caption generation, AI scoring, aspect ratio reformatting, export, and distribution features.
Subject to your compliance with these Terms and applicable law, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services within the scope of the plans, credits, and features that you purchased or were otherwise allowed to use.
Unless we expressly agree in writing, you may not copy, resell, rent, sublicense, mirror, scrape, republish, or otherwise make the Services or any part of them available to third parties.
5. User Content, Rights, and Authorization
You are solely responsible for the content, materials, project files, instructions, metadata, and related information that you upload, import, synchronize, edit, generate, or publish through the Services (collectively, "User Content"). You must ensure that you have lawful, sufficient, and continuing rights or permissions for such User Content, and that it does not infringe any third party's intellectual property rights, portrait rights, privacy rights, trade secrets, or other lawful interests.
To provide the Services to you, you grant us and our technical service providers a worldwide, non-exclusive, sublicensable license, limited to what is necessary for the Services, to store, copy, process, convert, analyze, generate, export, transmit, and display your User Content for the sole purpose of providing, maintaining, supporting, protecting, and improving the ShortMind Services.
Unless required by law, necessary to provide a feature you actively choose, or otherwise separately authorized by you, we will not use your User Content for public display, promotional use, or training addressed to unspecified users for purposes unrelated to providing the current Services to you.
6. AI Outputs and Human Review Responsibility
Titles, copy, captions, scores, labels, packaging suggestions, export files, and any other results generated by ShortMind (collectively, "Outputs") are provided as tool-generated results for your reference and use.
Because of the limitations of algorithms and models, Outputs may contain errors, omissions, bias, repetition, delays, or other issues and may not match your expectations. Before publishing, commercially using, delivering to clients, publicly distributing, or otherwise relying on Outputs in a high-risk context, you must complete appropriate human review, fact-checking, copyright review, and compliance review.
You are responsible for any complaint, dispute, infringement claim, penalty, or loss arising from your use, modification, distribution, licensing, or publication of Outputs, except to the extent otherwise required by law or caused by our intentional misconduct or gross negligence.
7. Prohibited Conduct
If we reasonably believe that you have engaged in any of the conduct above, or in other conduct that may jeopardize the Services, users, third-party rights holders, or the public interest, we may take necessary measures such as removing content, limiting functionality, freezing credits, suspending or terminating accounts, refusing transactions, and preserving our right to pursue legal remedies.
- Uploading, generating, or distributing content that violates applicable laws, regulations, regulatory requirements, public order, public morals, or platform rules.
- Uploading or using copyrighted films, music, images, brand assets, portraits, or other protected materials without authorization, or otherwise infringing third-party rights.
- Using the Services to generate or distribute fraudulent, impersonating, defamatory, harassing, discriminatory, violent, pornographic, gambling-related, misleading, deepfake, or otherwise high-risk content.
- Bypassing, interfering with, reverse engineering, scraping, scanning, or otherwise disrupting the security mechanisms, limits, access controls, model protection measures, or stability of the Services.
- Using Outputs from the Services to train, fine-tune, build, or evaluate a model, service, or product that directly competes with ShortMind.
- Bulk exporting, sharing, reselling, or transferring accounts, credits, API keys, usage quotas, or other access rights.
- Submitting automated or abnormal requests that impose an unreasonable burden on the Services, including mass scraping, probing, or abusive API behavior.
- Impersonating others, forging identity or authorization, misrepresenting the source of rights, or filing misleading, malicious, or bad-faith complaints or appeals.
8. Fees, Subscriptions, Credits, and Refunds
ShortMind may offer free trials, subscription plans, enterprise services, prepaid credits, add-on credit packs, or other paid functionality. The specific pricing, billing cycle, credit allotment, feature scope, validity period, and usage limitations will be governed by the pricing page, order page, quotation, or any separate written agreement applicable at the time of purchase.
If you choose an auto-renewing service, we will present the renewal rules, cancellation path, and related information before charging you, in accordance with applicable law and platform rules. You are responsible for monitoring your plan status, payment method validity, and renewal settings.
Except where otherwise required by law, expressly promised on the relevant page, or agreed by us in writing, subscription fees already charged, credits already delivered, and resources already consumed are generally non-refundable. If mandatory law gives you a statutory right to cancel, withdraw, or obtain a refund, we will handle that right in accordance with applicable law.
Credits may generally be used only by the purchasing account or the team entity expressly permitted by us, and only within the scope of the Services. Credits may not be withdrawn, gifted, split, resold, converted to cash, or used for any unlawful purpose. Credit consumption, expiry, and feature scope are subject to the terms presented at the time of purchase.
If a payment fails, is reversed, is flagged for fraud risk, or is associated with a policy violation or account anomaly, we may suspend related features, freeze credits, cancel orders, or take other reasonable measures.
9. Third-Party Services and Platform Integrations
ShortMind may integrate with third-party platforms, cloud services, payment services, storage services, AI model providers, or content distribution capabilities. When you use those features, you must also comply with the terms, rules, and policies of the relevant third-party providers.
When you actively connect platforms such as YouTube, TikTok, Instagram, or LinkedIn, you authorize us to read, process, transmit, and return relevant data to the extent necessary to provide the requested functionality. You are responsible for ensuring that you have the right to connect the relevant platform accounts and perform the related operations.
The availability of third-party services, interface permissions, content review outcomes, account suspensions, payment failures, policy changes, or service interruptions may affect your use of some ShortMind features. Where a loss is caused directly by a third party, we may assist you in troubleshooting within a reasonable scope, but we do not make additional guarantees about the third party's conduct.
10. Intellectual Property, Branding, and Infringement Complaints
The intellectual property rights in the ShortMind website, software, interface, code, copy, trademarks, logos, layouts, workflow designs, and related technical achievements belong to us or the relevant rights holders. These Terms do not grant you any license to the ShortMind brand, software, or underlying technology except as expressly stated by us in writing.
If you believe that content available through the platform infringes your intellectual property rights, portrait rights, privacy rights, or other lawful interests, you may submit a complaint to us at support@shortmind.ai. Your notice should include proof of rights, the relevant link or locating information, a description of the facts, and your valid contact details. We will process complete notices in accordance with applicable law and our platform rules.
If you submit suggestions, ideas, feedback, testing comments, or improvement proposals to us, you agree that, except where otherwise required by law, we may use such feedback to improve the Services without additional compensation to you.
11. Changes, Suspension, and Termination of the Services
To the extent permitted by law, we may modify, suspend, interrupt, or discontinue some or all of the Services for maintenance, upgrades, incident handling, compliance requirements, risk control, commercial arrangements, or force majeure.
If you violate these Terms, fail to use your account for an extended period, present an abnormal risk, fail to pay fees, become involved in disputes, or where otherwise required by law, we may reasonably restrict, suspend, or terminate your access to the Services, and may delete relevant content, freeze credits, or preserve information that must be retained by law.
After the Services are terminated, we may delete User Content, projects, and log information related to the terminated Services unless otherwise required by law, agreed by the parties, or necessary for technical reasons. Please back up your important content in a timely manner.
12. Disclaimers and Limitation of Liability
ShortMind is provided on an "as is" and "as available" basis. We will make reasonable efforts to maintain service stability and security, but we do not guarantee that the Services will be uninterrupted, error-free, or delay-free, nor do we guarantee that AI Outputs will always be accurate, complete, merchantable, fit for a particular purpose, or sufficient for all of your business needs.
To the maximum extent permitted by applicable law, we are not liable beyond what is required by law for losses arising from network environments, third-party platforms, cyberattacks, system failures, force majeure, regulatory changes, your own actions, third-party infringement, or other circumstances not caused by our intentional misconduct or gross negligence.
To the extent permitted by applicable law, our aggregate liability to you for all claims relating to the Services will not exceed the total amount of fees that you actually paid to us for the relevant Services during the twelve months preceding the event giving rise to liability. If you have not paid any fees, our liability cap will be RMB 100 or any other minimum amount required by applicable law, whichever is more favorable to you.
13. Indemnification
If your breach of these Terms, applicable law, or third-party platform rules, or your User Content, use of Outputs, or account activities infringe a third party's lawful rights and thereby cause us or our affiliates to incur claims, penalties, losses, expenses, or liabilities, you will be responsible to the extent permitted by law and will indemnify us for the resulting losses, including reasonable attorneys' fees, evidence collection costs, and rights-protection expenses.
14. Governing Law and Dispute Resolution
The formation, effectiveness, interpretation, performance, and dispute resolution of these Terms are governed by the laws of mainland China, excluding conflict-of-law rules. If mandatory laws in your jurisdiction apply, those mandatory provisions will prevail to the extent required.
Any dispute arising from or relating to these Terms or the ShortMind Services should first be resolved through friendly consultation. If no resolution can be reached, either party may bring the dispute before a people's court with competent jurisdiction in Guangzhou, Guangdong Province, China, or otherwise use any dispute resolution mechanism separately agreed by the parties in writing.
15. Miscellaneous
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to exercise or enforce any right under these Terms does not constitute a waiver of that right.
